User Agreement / Terms of Service

Oswald Sporting Ltd

This User Agreement (“Terms of Service”) is a legal agreement between you (“User”, “Client”) and Oswald Sporting Ltd (“Oswald”, “we”, “us”, “our”) governing your access to and use of our website, ordering systems, design tools and services.

By accessing or using this website, placing an order, or continuing to use our services, you agree to be bound by these Terms of Service. If you do not agree, you must stop using the website and services immediately.

Our website and ordering platform are provided using DecoNetwork technology. DecoNetwork acts as a platform provider only and is not a contracting party to any sale of goods.

1. Oswald Services

Oswald provides services including, but not limited to:

• Creating, designing and customising garments and products

• Selling made-to-order and stock products

• Providing online tools to view, customise and submit designs

• Allowing users to save designs, submit artwork and place orders

• Communicating order updates and customer support

2. Use of the Website and Services

2.1 Eligibility

You must be legally capable of entering into binding contracts to use this website and place orders.

• Users under 18 may only place orders with the involvement and consent of a parent or legal guardian.

• Children under 13 may view the website but may not place orders or submit personal data.

2.2 User Responsibilities

Users are solely responsible for:

• Maintaining access to the internet and required devices

• All activity conducted through their account

• Ensuring any artwork, logos or content submitted are lawful and authorised

• Complying with all applicable laws and regulations

 

2.3 Prohibited Use

Users must not use the website or services to:

• Infringe intellectual property rights

• Upload unlawful, defamatory, offensive or misleading content

• Upload viruses, malware or harmful code

• Attempt to reverse-engineer, copy or misuse the website or tools

• Interfere with the operation or security of the platform

• Misrepresent identity or authority

Oswald reserves the right to suspend or terminate access for any breach.

 

3. Orders & Contract Formation

A legally binding contract is formed only when Oswald issues a written order confirmation.

Quotes, visuals and mock-ups do not constitute acceptance.

Full payment is required before production begins, unless agreed otherwise in writing.

 

4. Artwork, Content & Intellectual Property (Client)

The User warrants that they own or have permission to use all logos, artwork, images and content submitted.

The User agrees to indemnify Oswald against any claims arising from unauthorised use of submitted materials.

 

5. Intellectual Property (Oswald)

All website content, layouts, templates, visuals, mock-ups, tools and design systems remain the intellectual property of Oswald or its licensors.

Users are granted a limited, revocable licence to use the website for its intended purpose only.

 

6. Promotional Use of Orders

Unless a written request is made prior to production, Oswald may photograph, film or otherwise capture content relating to orders for use in:

• Marketing

• Social media

• Website content

• Case studies

Retrospective requests to remove or restrict use of content cannot be accepted, due to the costs involved in producing and distributing promotional materials.

 

7. Availability & Platform Changes

Oswald may modify, suspend or discontinue any aspect of the website or services at any time without liability.

Oswald is not obliged to provide training or ongoing support for use of the website tools.

 

8. Warranties & Disclaimers

The website and services are provided “as is” and “as available”.

Oswald does not guarantee that:

• The website will be uninterrupted or error-free

• Tools will meet all user requirements

• Content will be completely accurate at all times

9. Limitation of Liability

Nothing in these Terms limits liability for death or personal injury caused by negligence or for fraud.

Subject to this:

• Oswald shall not be liable for indirect or consequential losses

• Oswald’s total liability shall be limited to the value of the goods supplied

10. Termination

Oswald may terminate or suspend access immediately where:

• These Terms are breached

• Payment obligations are not met

• Continued use poses legal or reputational risk

Users may terminate this agreement by ceasing use of the website.

 

11. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force.

 

12. Variation

Oswald may amend these Terms from time to time. Updated terms will take effect when published on the website.

Continued use of the website constitutes acceptance of revised Terms.

 

13. Governing Law & Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction.
